A Uniquely Evil Plan

We make special reference to the consortium's plan as an indication of how far the consortium and specific SAPS officers, especially Serg Stevens, were willing to go in an attempt to frame the client.

 

One of the most wicked, corrupt, illegal, and criminal parts of the campaign was the plan by Wouter de Swardt, SAPS, and the key consortium members to create victims. In December 2022, despite investing enormous time, resources, and money into investigating every aspect of the client, including five private investigators, several police stations/units, the various members of the consortium, and anyone they could scare, bribe, or threaten into assisting, not one shred of evidence had been found and not one single victim. Rather than give up that pursuit, it was decided to create victims.

 

It was decided that after the December arrest, Wouter de Swardt, SAPS, etc. would not inform the platform that the three residences were no longer under the control of the client and that in fact the client was incarcerated in Pollsmoor. Had they done so, the platform would have contacted all tenants and arranged alternative villas and refunds if their guests were dissatisfied with the options. Likewise, once notified, any affected guests could process a chargeback on their card. In either case, there would be no loss, other than the minor inconvenience of changing villas [2].

The Plan In Action

But it was essential if guests were to be turned into and portrayed as victims that do not happen. Not only did they neglect to inform the platform immediately after the arrest, but they also neglected to do so in the weeks that followed. In fact, they failed to inform the platform after each group of guests turned up, as planned, only to find upon arrival they were homeless; the villa had changed hands weeks or months earlier, and having paid the money at the point of booking, they were now substantially out of pocket.

 
Lying in wait to meet each set of guests, Mr de Swardt  and IB told all of them “they had been scammed, were one of thousands, and stood no chance of recovering the money paid or getting an alternative villa, and that in fact their only recourse was to lay criminal charges, supplying the details of SAPS Hout Bay to do so. 
 
They were aware that if they had contacted their platform and/or credit card company, they could have secured both alternative villas and a refund. Instead, the manipulation was clear and deliberate, steering them away from the paths leading to relief and toward those that would result in the most losses and distress.


They deliberately neglected to notify the platforms about the villas' ownership transition following the arrest in December, anticipating that hundreds of families and groups would arrive for their vacation as scheduled, only to discover upon arrival that they had no place to stay.

The Clear Difference With A Genuine Fraud Investigation 

When a genuine fraud arrest occurs, one of the police's primary roles, if not the primary role, should be to ensure there are no more victims. If the scam was for a bogus hotel, taking reservations for a place that did not exist, the police would both try to get hold of any victims as soon as possible but also ensure that there were no more victims by pulling down the advertisements and informing booked guests they needed to make alternative plans.

 
The same principle applies to a food wholesaler who deceives customers by selling tainted or contaminated food. Following an arrest, you would promptly track and trace customers, including those already impacted and those at risk.

 
Whatever the scam, whether fake airline tickets, dodgy credit cards, etc., the police do not close their operation when an arrest has been made. Often, in fact, the majority of the investigation starts once an arrest has been made, as well as once files, devices, data, and documents have been seized.


I cannot think of a single example of an investigation, especially one into fraud, where the operation ceases once the accused is arrested. Other than Serg Stevens' false affidavit, the docket has not had a single new or additional piece of evidence or activity since my arrest.

This was entirely false.   The arrest was not the second for fraud and no new victims had come fgorward.

The Very Deliverate Divergence From A Bone Fide Investigation

Why, when you arrest someone for fraud, do you not ask them a single question, conduct an interview, or obtain a statement? No one asked me a single question about my alleged scam during the arrest, my days in Hout Bay cells, or my three-month stay in Pollsmoor.

 

Mr. de Swardt and his colleague, Serg Stevens, alleged that the company was a fraudulent enterprise. We had six large residences; according to Mr. de Swardt, Serg Stevens, and SS, we took double, triple, and quadruple bookings. With six residences and an average stay of three days, this equates to 60 stays per month, 720 stays annually, and an average group size of 12, which translates to 8,460 guests annually. When I was arrested, there could have been thousands of guests who had already booked and were expecting to stay. Unless told otherwise, they would simply turn up.

 

Furthermore, due to their deliberate failure to notify the platform, the system continued to function without any staff for a period of TWO FULL MONTHS, accepting new bookings that were unable to be fulfilled due to the owners reclaiming their properties.

The Inentional Failure to Inform The Platforms

In the News24 articles, fabricated by Mr. de Swardt/Serg Stevens, he claimed I scammed R32 million in one year alone. Which would mean that there would be R32 millions of bookings in the year after my arrest, and yet they did not make the slightest effort to investigate or contact the platform.

 

And they knew how, because they had become experts at contacting our platforms to have our profiles removed. 

 

So, whether it be to investigate the supposed fraud, whether it be to establish past victims, whether it be to stop guests from becoming victims, whether it be to ensure the platform found the guests alternative accommodation, or whether it be to notify guests so that they were within the three-month window of cancelling payments on their credit cards to get refunds, the call to the platform should have been the first thing done after the arrest.

 

However, that call was not made. They didn't make that call on the day of my arrest or the following day. Not even that week. Not when I was sent to Pollsmoor or any of the time I was in Pollsmoor. And crucially, not even after each set of guests turned up completely distraught, they were homeless and out of pocket.

Waiting For Their Victims To Arrive

The private investigator and IB initially ‘camped out’ at one of the properties (16 LR) in order to catch guests as they arrived. In breach of the interdict from the High Court. A property they had taken possession of within hours of their instructed PI Wouter de Swardt/Investigating Officer Serg Stevens have retaken it disguised as a raid and arrest.


When guests arrived expecting to check-in, they were told a series of lies: that they were victims of an elaborate scam, one of thousands of victims, and that they stood no chance of recovering their money or getting alternative accommodation other than through their own efforts; that their only remedy to the immediate situation was to find and fund an alternative villa, and their only recourse or remedy thereafter was press charges.

 

While hiding the fact that A) when the client took the bookings, he was the sole and legitimate tenant and had every right to do so, the properties were, B) they were the reason the property was not available for them, and C) they were also the reason they had not been told in advance. Encouraging them to lay charges instead of pursuing routes and remedies that would have given them both refunds and alternative accommodation. Intentionally pushing and pursuing a path most likely to cause the guests the most losses.

The Notes On The Properties

In addition, or when they could not be at the property to greet them, Wouter de Swardt and the Investigating Officer Serg Stevens put notes on the doors and fronts of the houses, telling the guests that they have been scammed.

 

Kindly providing the Mr de Swardt's phone number to call so he could ‘assist them in their distress.’ Whereas in reality, Wouter de Swardt and the Investigating Officer Serg Stevens were manipulating them into acting as they and the consortium needed.

 

Inentionally not encouraging them to pursue the multiple solutions available to them, including chargebacks, refunds, or alternative villas as they would have been entitled to.  Instead steering them to laying criminal charges. 

Sreeing Guests Away From Resolution To Ensure Loss And Damage

i had designed the system with the explicit intention of including such safety measures. From the unexpected departure of MB to the arrest, the only period since March 2022 where the client had been in sole control of the bookings system, the client only accepted bookings through one source, i.e., platforms. No bookings were accepted directly, through Instagram, or through the website. And, through only one platform. Booking.com was chosen because it underwrites all bookings, providing guests with maximum security and peace of mind.

 

Underwriting and guarantees that were ultimately funded and underwritten in turn by the account holder, i.e., the client. As a result, all of the client's guests benefited from Booking.com's considerable resources, which could quickly find an alternative villa or issue a refund if the offered villas were not acceptable.

The Mechanics Of Their Fraud

However, in order to successfully misrepresent fraud, certain elements were necessary:

 

  • An intention to gain financially at the expense of another,

  • The victim has endured losses as a consequence.

  • People willing or motivated to then lay charges.

 

They had successfully

  • Created "victims," although in nothing like the numbers they had expected.

  • They had built up the scam narrative and provided everyone with plenty of “evidence” of the scam (news24, petition, Wouter de Swardt, the arrest).

  • Caused substantial losses to those who arrived to find they had no villa; and

  • I tried very hard to persuade everyone to go to the police.

 

Their hope was that if the position could be misrepresented enough, that they could cobble together sufficient dockets to give the impression of a scam enterprise, this would aid in multiple respects:

 

  • In order to formulate another attack against the client,

  • To motivate or justify another arrest as and when needed,

  • To aid in stalling the bail application and thereby elongating the period of incarceration, using these supposedly new cases to extend the period of demand while they were investigated.

  • To aid in ensuring the client lost the bail application when it eventually started.

 And importantly,

  • To aid in their civil court appeal against the December ruling

The Thousands Of Potential And Hoped For Victims

It was essential that these guests, or newly created victims, remain out of pocket. Or their chances of either prosecution or using the cases as evidence of fraud would fall away.

 

Had each received a refund from the client, platform, or card company, fraud would have been prevented and their plans wasted.

 

Therefore, Wouter de Swardt and the Investigating Officer endeavoured to dissuade guests from engaging or reaching out to the platform, their card company, or the client.


Based on this, there could have been anywhere between 400 and 1,4000 for the summer season, which immediately followed the arrest, and between 1200 and 4,000 for the year following the arrest. 

 

Wouter de Swardt/Investigating Officer Serg Stevens had no sight of the diary prior to the arrest, so he could not have known the precise numbers.

However, it was likely that thousands would have been affected.  For the consortium, the higher the number of victims, the higher the likelihood of fraudulent misrepresentation.

The failure to inform the platform was intentional, and the goal was to create as many victims as possible.


As stated, at no point just after the rest or in the week following, nor at any point over the following weeks and months, as guest after guest arrived, did any of them inform the platform.

The Dossier

This plan was then put into writing: In the dossier...

Including in the criminal proceedings of December 2022 through September 2023. Keith initiated civil proceedings within 24 hours of my arrest and attempted to push them forward while I remained in prison.

The claims in Wouter de Swardt's dossier are unambiguous and unequivocal. He claimed that all eleven groups of guests made payments to the Cape Exclusive Residences bank account and that they were all scammed, meaning that the bookings were made without any intention or ability to deliver the booked stays.

Because some groups had similar dates to others, this was misrepresented as a double-booking scenario.

 

They conveniently omitted to mention several important facts.

  • That the villas were mine to take bookings on as I wished. The fact that the villas were not under my control when the guests arrived had no bearing on the status at the time of booking.

  • The additional fact that there was not one residence but three residences.


Instead, they misrepresented the position, as if I had no right to take the bookings in the first place, and that there was only one residence. And of course, as addressed below, that all paid money to me.

The Reality

In reality, for there to have been a double booking, it was academic as to how many guests turned up for dates that crossed. What was essential was that.

 

  • Those guests who turned up were guests from whom I accepted bookings.

  • And that had booked the same property for the same dates or dates that crossed.

 

There were no such guests.

 

Nonetheless, for those statements made in the dossier to be valid, the claim—i.e., that they all paid C.E.R. and had confirmed bookings—would also need to be correct.

 

However, the sole guest who made payments into the C.E.R. bank account for a stay that clashed with anyone else did so independently, without consulting C.E.R. They saw the advertisement, processed an online booking without consulting C.E.R., transferred funds without consulting C.E.R., maintained no communication with C.E.R., and did not receive an invoice from C.E.R. All these actions took place after the arrest.

 

Out of the eleven guests, only one, Campos, had communicated, paid for, and received confirmation of their booking. Campos had not made a payment into the C.E.R. bank account but had instead made a card payment.

 

It would have been impossible for those who did not actually pay C.E.R. to know the C.E.R. bank account details or for those people to know the C.E.R. name. 

For example, many will have mentioned Mario at Cape Twon Luxury, but Wouter de Swardt appears to have changed this key information between the time the guests gave it to him and when he wrote the dossier.

 

Therefore, Wouter de Swardt cannot portray this as a massive error or negligence; if he had claimed categorically that the guests told him they had paid C.E.R., they would have had to explicitly state this, which those who did not could have done.

The Conclusion

For the entire summer season and the majority of the year, the properties had large notices on their frontage, as well as guests, owners, and staff in occupation, and for a significant portion of the start of the summer season and the entirety of the peak season, the landlord was in residence and waiting to greet guests with the assistance of Wouter de Swardt. It is safe to assume that they captured every group of guests arriving at one of the three residences only to discover they had no place to stay.


If there was a scam going on that accepted double, triple, or quadruple bookings at the three residences, hundreds of guests should have arrived.


Crucially, the client's removal occurred instantly and without warning. From the outset, the arrest decapitated the system. Following the arrest, the client found himself imprisoned, unable to access or control the system, make any changes, contact any guests, or perform any other actions. As a result, there was no better way to obtain a completely accurate and unfiltered analysis of the operation. The analysis encompassed not only the period of the clients' arrests and subsequent release, but also the entire peak and summer season, along with the subsequent year.

 

The owners' control and occupation of the properties entailed an equally unrestricted and unfiltered ability to monitor and document all guests who would inevitably arrive, as there was no way for the client to contact or divert them. So, whatever was in the diary for the year on December 13, 2022, would have been reality on the ground.

Without the ability to intervene, once the cons were tossed into the air after the client’s arrest, they landed where they landed.


The reality was that of the bookings taken by the client, there was not a single double booking among the three residences.


In fact, if there had only been one residence, there would not have been any double bookings.

 

There could not have been a more perfect way to have a direct, real-time, unfiltered, and transparent view of every aspect of the operation, the diary's workings, and the bookings.

 

The science, math, and logic are extremely clear; having had the most perfect opportunity to examine the actual workings of the diary and bookings, constructed in such a way as to represent perfect test conditions, there was not a single double booking.


Further, there was not one single example of double booking during 2022 or 2023.

Proof Of The Plan To Create Victims Was The Dossier Itself

What Mr. de Swardt and Serg Stevens seem to have missed is that the dossier they produced is black-and-white evidence of their own crimes.

 

Wouter de Swardt was the private investigator working for the landlords of 16 Leirmans Road and 32 Fisherman’s Bend, appointed by Keith and Inge Broad owners of 16 Leirmans Road, Sergeant Stevens was the investigating officer investigating officer, who organised and executed the arrests, search and seizure at 16 Leirmans Road and 32 Fisherman’s Bend, and who enabled the unlawful takeover of both properties, the unlawful appropriation of the keys which were then passed to those same landlords.

 

The fabricated premise of the arrest was that as a ‘host’ renting out the properties, I was taking double, triple and quadruple bookings with no intention of accommodating guest, instead leaving them to arrive only to find out on arrival they had no villa to stay in.

 

When Serg Stevens  and Mr de Swardt  arrested me, unlawfully passed the properties to the owners,  and kept me detained, that they had decapitated the entire operation and that from that day forward there were no villas available for any guests to stay in.

A Deceit That Lasted Three Months

They knew what would happen if they did not notify the platform of this very fundamental change in circumstances; they knew guests would show up only to find that they were homeless and out of pocket. But rather than inform the platform, they kept Booking.com in the dark and instead they lay in wait for each set of guests and collected their details for use in civil and criminal courts by misrepresenting the guests as defrauded.

 

The owners of Fisherman’s Bend or Leirmans Road put several notices on the front of their properties telling guests they had been scammed and providing the mobile number for Wouter de Swardt

 

And each time another group of guests arrived, they failed to tell the guest that they were the reason that the guests were standing at their homeless and out of pocket. Because:

 

  • Firstly, it was Serg Stevens along with Mr. de Swardt’s who had executed the unnecessary and unlawful arrest (to effect and disguise two illegal evictions), and it was therefore they who were responsible for taking the properties away and

  • Secondly, they compounded this by purposely not letting informing the platform of this game changing event, to avoid a situation where the platform would find the guests alternative accommodation or provide a refund

 

Just as each time another group of guests arrived they again failed to inform the platforms. So Wouter de Swardt, SAPS and each landlord (who by virtue of my illegal eviction were back in occupation) had no issue inflicting such a distressing experience and such significant loss on each group of guests, and despite each occasion they experienced that first hand in front of their own eyes they continued with this cruel project.

 

We do not know how many guests turned up over this period. I was unlawfully detained in Pollsmoor prison for that entire period, and they were the only people to have a physical presence at the properties. But whether it was a hundred and fifty guest or three hundred guests or any figure, the ONLY reason they were stood their homeless, distressed and tens or hundreds of thousands of rand worse off, was because of Wouter de Swardt, Serg Stevens  and the respective owners of Leirmans Road and Fisherman’s Bend

THE CONSORTIUM'S REPUGNANT PLAN

But as a minimum, what we do know is that at least eleven groups of guests arrived (representing around one hundred and forty people) because Inge Broad and Mr de Swardt  himself kindly took their details to submit to the courts in the most astonishing example of hypocrisy

The list of 11 groups of guests produced by Serg Stevens and Mr. de Swardt’s to aid them in the civil and criminal courts is ample proof of both the crime, the victims, and the cost of that plan.


A plan that was intended to impact every single guest who had a booking for dates after my arrest, which had the potential to be thousands of people.

How The System Would Have Operated Without Interference 

Our Farai booking for the eleven groups of guests is for different dates and amounts, indicating that it is not the same guest or booking. We searched each name on the Wouter de Swardt dossier for Farai Mars and found one. We checked, and his stay was processed like any other booking.

We had no money, pipeline, systems, bank accounts, or credit card processing facility when Mario left. Our only assets were the profiles I had managed since early 2021.

I had to start over and make sure we had a channel manager, only took Booking.com bookings, and pushed card payment as much as possible. This gave guests two ways to avoid issues like scheduling conflicts, villa shortages, and cancellations. My Booking.com and card processing accounts were in my name, so I guaranteed every booking. Whether we accepted or confirmed the booking, I guaranteed it.

Farai used a credit card to book in the automated booking.com system. After arriving at the villa, he complained to Booking.com and his credit card company. He received two refunds to prove MY system worked. He received refunds from Booking.com and his credit card processor.

I personally funded both with my Booking.com and card processing accounts.

The R10,000,000 Cost Of Their Plan

Instead of R10 million in summer bookings or R20 million for that and 2023, I have more than a million Rand in Booking.com fees for bookings processed in 2022 and 2023 that never happened, as well as a bill for over a million rand in refunds or alternative villas. Plus, a similar amount from the card processor. Under my name. Also, card processing fees.


Thus, all refunds, fees, and no revenue. Please explain how my system can be misrepresented as fraudulent. Absolute opposite of fraud.

 

This shows the effectiveness of my system, even though no guest should receive two refunds. This proves I insured all my guests. Which is possibly why Wouter de Swardt has not included any who booked between January and July via me, as they would have simply contacted Bookinb.com, who would have found them an alternative villa from the hundreds they have and then billed me for both the full cost of the stay and any premium rent required due to the last-minute booking, resulting in almost certainly higher rental charges than they had paid

 

In the event that Booking.com could not find a villa, they would refund my deposit. A guest who paid by card could file a chargeback, which will go through unopposed and result in a full refund at my expense.


Every guest offered these options. Of all my bookings, only Campos and Kwandi have not taken that route or used either option. What a coincidence! Why? Because Wouter de Swardt tried to convince them they had been scammed, that they were one of thousands, that they had no hope of recovery, and that they had to find and fund their own villas. He and Inge knew a single call to their platform or card company would have fixed the problem, so they tried to steer them towards loss and a SAPS station to report a crime.
